EUROPEAN COURT OF JUSTICE AND PRELIMINARY RULINGS

 

Summary

 

European Court of Justice (ECJ) was the central body in the process of creating Supranational Law in the European Union. One of the powers entrusted to it and used during that process was a Preliminary ruling procedure from article 234 (177) of the EC Treaty. As the structure of the EU becomes more complex, ECJ becomes more influence. The original conception of relationship between ECJ and national courts was horizontal and bilateral cooperation. In time, that relationship becomes more vertical and multilateral, where ECJ sits in a superior position to that of the national courts. That development one can clearly see in the ECJ�s rulings presented in this work. It is hard to predict whether the ECJ will become kind of Supreme Court of future federal Europe, or its powers will decline under the pressure of the national states of Europe.
